EB1: No Forward Movement, But Still the Best Bet

EB1: No movement

If you’re hoping for movement in the EB1 category, there’s not much to celebrate this month. The Final Action Date is stuck at February 1, 2022, and the Date for Filing hasn’t moved from April 15, 2022.
 
While the lack of movement can be frustrating, the EB1 category still offers one of the shortest wait times for Indian applicants. A backlog of over two years may not be ideal, but it’s still significantly better than the decade-plus wait in other EB2/EB3 green card categories.

EB2 India – Minor Advancement

The Final Action Date for EB2 India has moved forward by six weeks to December 1, 2012, while the Date for Filing remains at January 1, 2013.
 
Although this is a step forward, the backlog remains extensive. If you’re in this category, it’s important to stay informed and consider alternative options if you’re looking for a faster path.

EB3 India – Small Progress

For EB3 India, there has been some movement as well. The Final Action Date has advanced by six weeks to February 1, 2013, while the Date for Filing remains at June 8, 2013.
 
These small changes show slow progress. Demand in this category remains high, and unless visa availability increases significantly, progress will likely continue at this pace. This is concerning, as the backlog stretches over decades.

Adjustment of Status: Still No Green Light

One of the biggest disappointments this month is that USCIS is not allowing applicants to use the Date for Filing chart to submit Adjustment of Status applications. This means that even if your priority date falls within the Date for Filing range, you’ll have to wait until your Final Action Date becomes current before applying for your green card.
 
For many applicants who were hoping to file their I-485 applications soon, this is yet another roadblock.

Many Indian applicants believe the EB1A is out of reach because it requires ‘extraordinary ability.’ In reality, it’s not about being famous; it’s about demonstrating the impact of your work in the field.
