Smart Green Card: A Mechanical Engineer's EB-1A Triumph After NOID Response

Kamlesh R. is a mechanical engineer with 10 years of experience in the medical device industry. He currently leads the catheter design team, where they develop catheters to insert prosthetic valves into patients, replacing damaged ones.

Before the Smart Green Card Program, I felt stuck. But Saiman and his team showed me a path forward. They provided the inspiration to dream about having a green card, and more importantly, the tools and guidance to make it a reality. I appreciate their dedication to constantly improving the program, and I have no doubt it will continue to empower many more people like me. Thank you, Saiman and team!

Kamlesh R - Mechanical Engineer

Like many highly skilled immigrants, he has been living in the US without a green card, facing uncertainty. Kamlesh discovered the Smart Green Card program through an advertisement and, recognizing his expertise, he joined our program to begin his EB1-A journey.

Kamlesh’s EB1-A story has had its ups and downs. He even received a Notice of Intent to Deny (NOID) for his EB1-A petition, which is challenging to overturn. However, with the support of Smart Green Card, he successfully overcame these obstacles and achieved EB1-A success. Let’s read his story to get inspired.

How does the Smart Green Card help him navigate the EB1A criteria?

After Kamlesh enrolled in the Smart Green Card program, we worked with him to craft a personalized EB1A action plan, which served as a roadmap for building an EB1A profile.

With our tailored strategy, Kamlesh targeted seven EB1A criteria: critical role, original contribution, high salary, awards, scholarly articles, media, and judging.

Critical Role and Original Contribution:

Kamlesh believed he should hold leadership roles to demonstrate his critical role and thought he needed citations or patents to meet the original contribution criteria.

First and foremost, our team clarified that if his work impacted the organization and his field, he could demonstrate his critical role by leveraging this aspect. Secondly, our team clarified that he could submit alternative evidence based on his profile to satisfy the original contribution criteria.

The Smart Green Card team worked with him and helped him gather robust evidence to meet both the original contribution and critical role criteria.

For example, his papers received fantastic reviews from renowned physicians, and our team helped him leverage this aspect for his original contribution.

To demonstrate his critical role in his organization, our team helped him gather proof through recommendation letters. The Smart Green Card team assisted him in selecting the right recommenders from his network and provided guidance on the elements of the letters of recommendation.

Scholarly Articles:

Despite being an R&D engineer, Kamlesh had never authored a paper in his field and lacked knowledge of the publication process.

After joining the Smart Green Card program, our team assisted him in writing and publishing impactful papers. This included providing sample articles, guidance on the flow, format, and elements of papers, as well as strategies for approaching content. We also helped him identify relevant journals where he could publish his work.

With our team’s immense support, Kamlesh has authored 10 impactful articles in his field.

Media:

Kamlesh made significant contributions to the field. As a result, Smart Green Card’s in-house press team crafted a compelling narrative of his story and pitched it to over 1000 renowned journalists using our extensive network.

While our team does not influence journalists’ decisions, many are willing to feature our client’s story. This approach helped Kamlesh secure 5 organic press coverages discussing his work in major media outlets.

Organic press coverage requires time, effort, and patience. This is why PR firms do not prioritize this approach. Paid press coverage is not accepted by USCIS as evidence of extraordinary ability.

Judging and Awards Criteria:

Kamlesh faced difficulty in finding judging opportunities in his field, despite continuous pitching to several journal editors. When he approached our team, we developed a solid strategy. This included guidance on crafting personalized pitches, diversifying his judging activities, and providing specific judging opportunities in his field. As a result, Kamlesh judged 5 different awards and reviewed 7 papers.

Kamlesh was unsure about the EB1-A award standards. Our team clarified that the lesser nationally or internationally recognized awards qualify if they are granted based on outstanding achievements in the field. We also provided him with award opportunities that he could apply for. With our help, Kamlesh secured three awards in his field, including one from a congresswoman.

Overturned the NOID with Smart Green Card Support:

“When I received a NOID for my EB1A petition, I couldn’t digest it because I believed my case was strong. I then conducted a gap analysis based on the details in the NOID response, which gave me the confidence to proceed. My NOID response was 60 pages long, and we addressed each comment made by the officer”, Kamlesh R.

When Kamlesh received the NOID, he contacted the Smart Green Card team for assistance. With our team’s guidance, Kamlesh conducted a gap analysis using the information in his NOID. He noted down the deficiencies and the facts that were overlooked by the officer. At Smart Green Card, our team always ensures that our clients understand the EB1A requirements well.

Kamlesh met three criteria: judging, awards, and high salary. However, his EB1A application was rejected in the final evaluation. Also, while his original contribution and critical role criteria were strong, both were rejected by the officer due to minor misconceptions. Let’s delve into the details.

Issue 1: In the judging criteria, the officer assumed that Kamlesh was a researcher based on his job title, R&D engineer. Consequently, the officer rejected this criterion in the final evaluation, stating that peer reviews were common for researchers and did not establish his significant role in the field.

Solution: To address this issue, our team recommended that Kamlesh obtain a recommendation letter from his VP, an expert in the field, detailing Kamlesh’s job role.

Issue 2: The awards were rejected in the final evaluation, with the rationale that they were only received in the past couple of years.

Solution: In fact, these awards recognized Kamlesh’s significant contributions to the field over the past 15 years. Therefore, our team helped Kamlesh highlight this crucial point.

Issue 3: Recommendation letters for original contributions and critical roles were rejected because the contact details of the recommenders were not included, despite their contact information being in the attached resumes.

Solution: Our team suggested updating the letters with the contact details and also helped Kamlesh highlight that the recommenders’ contact information was already included in the attached CVs.

Conclusion:

Kamlesh’s EB1-A journey has been a rollercoaster ride. However, with the assistance of a Smart Green Card, he overcame all challenges and finally achieved his EB1-A.

Sometimes, misunderstandings of the facts in your EB1A petition can occur. It’s our responsibility to view it from the right angle rather than being demotivated by a NOID or RFE. Kamlesh’s case is a prime example.
